Ban on Gay Conversion Therapy Blocked by Judges

A state law that would block therapists from attempting to change a minor’s sexual orientation is on hold for now.

A federal appeals court has now put a hold on a new state law intended to prevent therapists from trying to change a minor’s sexual orientation, dealing a setback to gay rights groups, the Los Angeles Times reported Saturday.

A three-judge panel of the U.S. 9th Circuit Court of Appeals agreed to block the law, scheduled to take effect Jan. 1, pending a decision on its constitutionality, according to the newspaper.

The law was authored by State Sen. Ted W. Lieu (D-Redondo Beach).

“This is a very good sign for our clients” Mathew Staver told the Times. Staver is the founder of Liberty Counsel, a religious liberties group that sued to block the law, arguing that it violates free speech rights.

“To get an injunction pending appeal is a very difficult thing to do,” Staver told the newspaper.

A spokeswoman for state Atty. Gen. Kamala D. Harris said Harris would “vigorously defend” a law that banned what she termed an “unsound and harmful practice.”

The law would subject psychologists, psychiatrists and other mental health professionals to discipline by their licensing boards for providing minors therapy to change their sexual orientation. The state and many professional groups say the therapy is ineffective and potentially dangerous.

A District Court judge initially rejected the suit by Liberty Counsel, whose clients include a 15-year-old boy undergoing the therapy. The Christian-oriented legal group appealed that decision to the 9th Circuit.

The judges who are hearing the case are Alfred T. Goodwin, appointed by President Nixon; Edward Leavy, a Reagan appointee; and Milan D. Smith Jr., named to the court by President George W. Bush.

UC Irvine Law School Dean Erwin Chemerinsky, who believes that the law is constitutional, said its opponents “won this round.”

“This doesn’t determine the ultimate outcome by the 9th Circuit,” Chemerinsky told the newspaper. “It still has to rule on the merits, and it could well go to the Supreme Court. But obviously this is a preliminary loss for supporters of the law.”

California’s ban on trying to change a minor’s sexual orientation, the first of its kind in the nation, has divided the lower courts. The federal judge in Sacramento who refused to block the law was appointed by President Obama. She concluded that it did not violate the 1st Amendment. Her colleague on the same bench, appointed by President George H.W. Bush, concluded that it was likely that the law infringed on free-speech protections.

A task force report by the American Psychological Association in 2009 said the therapy could trigger depression, suicide and substance abuse.

The new law was supported by the California Psychological Association, the California chapter of the National Association of Social Workers and the California Division of the American Association for Marriage and Family Therapy.

Thanks Inshane, I sure will take care of my 2nd amendment right weapons. I hope we cave in on taxes since we all should pay more in taxes. Just like shoplifting, the tax increases will be passed onto the consumers LOL! Oh, yes, And thank you for defining my christianity.

Inshane has a good point. Us conservatives are obviously a minority. How did this happen? The anti-humanist's "zero population growth" is in direct conflict with the Bible's "be fruitful and multiply". It's our own fault for letting ourselves get suckered into their philosophy, and birth controlling ourselves into extinction.

Then he stuck the high-powered suction tube into the hole and sucked the baby's brains out. And they think we are monsters for supporting the 2nd amendment and defending life.

Shane your a moron. Prior to Bill Clinton being President the Democratic Party was hugely in disarray. There beliefs and values so antiquated the only President they could field since JFK was Jimmy Carter who was a miserable failure. Both Senate and the House were dominated by the GOP. Even with Nixon being impeached and resigning in disgrace the Democratic Party couldn't get it together. Even Democratic insiders stated the party was all but dead. Then comes along Bill Clinton. He changed the entire mindset of Democrats, he changed the belief system, changed their stratifies basically turning the Democratic Party on its head, he redefined the entire Dem Party to what it is now. To say the GOP is dead is Juvineille , you don't know that nor could you. Just like the Democratic Party it will redefine itself and will come back. Americans don't want a single party system.

I don't know anything about the Tea Party. Hillary hasn't stated she's running for anything. In addition she will have to overcome Benghazi. As for the fiscal cliff ...you obviously don't follow the independent polls, those polls state that they want Congress and the WH to comprimise and hold both parties equally responsible. Next. No one can't Státe where and how people will vote in the future nor will the fiscal cliff even be an issue in another 3.5 years away. The Democrats recently stated in regards to 2014 they will have a tremendous up hill battle for 2014. The people that voted the GOP into the house were very much aware of the fiscal cliff when they voted. You haven't raised any valid points yet, I'm stil waiting for you to formulate a single logical conclusion , are you 12 yrs old ?

The mark of a third world country is a very rich class, a large poor class and no middle class. That’s just where Conservatism has tried to lead us. Luckily Conservatism is losing the battle against Liberalism, but then it always does. I expect the Republican Party to resurrect itself, but it wont be the same. It’ll probably look like today’s Democratic party, which will have moved on. And please learn something about Socialism. Its less about other peoples money than Capitalism is.

That's a horrible description. I am generally opposed to such a horrible act. I do think there may be extremely rare circumstances when such a thing might be called for (it would have to be pretty extreme, I can't even think of such a circumstance but then I am not a doctor). I am pro choice but I don't think abortions should be done after the first trimester except in circumstances like what I just mentioned. The difference for me is that I don't believe the fetus has a soul until some time in the 3rd trimester. I don't follow any particular religion but I don't thonk any of them have the right answer anyway. At some point in time maybe science can answer that question.

From what I have heard, he causes trouble while his wife is out trying to support him and she has to call home constantly to see what he is doing. He needs a caregiver to change his diapers.

I haveRead More to agree that people must slow down when approaching that curve by the golf course and allow themselves enough time to merge into one lane. Those not familiar with that part of Douglas, really need to adhere to the warning signs that are posted, as they head in the direction of the base.
